The first witness examined was John Fernance, a farmer residing at Southhampton, who deposed: deceased was his wife; she was nineteen years of age last July, and the mother of two children, the younger being about three months old; she had not been in good health since her confinement- deceased had complained of headaches and been in low spirits ever since, she complained of being unhappy in her mind, and on one occasion asked witness, if he thought she would be happier, if she made away with herself; and she was in a low desponding way from ill health; witness and deceased took dinner on Christmas day, at Mr Bailey's and returned home about four o’clock in the afternoon; in the evening, witness went to Mr Rose's and upon his return home, about midnight, he found the children in bed and the deceased absent from home; failing to find any traces of her about the place, he procured the assistance of Mr Bailey, and went to examine the river, but could find no traces of her; on Saturday morning he saw her tracks at the edge of the river; witness was not present when the body was recovered; when witness left her the previous evening, she appeared to be about as usual; no quarrel had taken place between them- Leopold Girard, residing at Riverston, stated that he was informed by Mr Rose on Saturday morning that Mrs Fernance was missing from home and thought to be drowned; he proceeded to the place occupied by deceased in his boat, taking his drags, when on examination, he found a place where deceased had forced her way through the weeds, and tracks of bare feet leading into the river; after using grappling irons for a short time, he found the body near where the tracks went into the river, and in about ten feet of water, the river bank slopes for some distance from the bank; the body was cold and stiff when recovered; from the tracks witness had no doubt the deceased had walked straight into the river; Duncan McPherson was present with witness and assisted in removing and recovering the body; there did not appear to be any bruises or injuries on the body- Sarah Rose stated she was a neighbour of Mr Fernance's, and knew the deceased, who had been in ill-health since the birth of her last child, and in the opinion of the witness, deceased mind was affected; she was very low and desponding; witness believed her home was happy, and that she had no unpleasantness to contend with beyond the state of her health; deceased had taken very little food lately, and was very weak; she had examined the body, there were no marks of violence or bruises on it. The jury after hearing the foregoing evidence found- "That the deceased Jane Fernance drowned herself in the Clarence River, on the night of 25th December, while in the state of temporary insanity."

Three years after the death of his young wife, John Anthony Fernance married Susannah Elizabeth Walters at Kelso, near Singleton on the 10-5-1877.
